Department Background:

Florida's constitution guarantees that any person accused of committing a crime has the right to a jury trial. In most civil actions, a jury trial is also an established right. In order for individuals to exercise this right, the court must maintain a system of providing jurors for trials. As of January 1, 1998, the juror source list changed from the voter registration list to a data source of driver's licenses or identification cards issued by the Florida Department of Highway Safety and Motor Vehicles (DHSMV). The jury list must be updated annually pursuant to section 40.011, Florida Statutes, in which DHSMV will provide an updated source list in January of each year.

Jurors who are regularly employed and who continue to receive regular wages while serving as jurors are not entitled to receive compensation from the state for the first three days of juror service. Jurors who are not regularly employed or who do not continue to receive regular wages while serving as jurors are entitled to receive $15 per day for the first three days of juror service.

The function and services of the Jury Assembly Department are:
To provide a maximum number of jurors to be summoned for any trial

To assist professional staff with the efficient management of juries

To execute a courteous and professional process from the initial notification of citizens    summoned to the payment of juror service

To provide prospective jurors with clear information concerning the date and time to    report for jury duty, the location of the courthouse, where to park, where to report, and    what to expect when reporting for jury duty

To explain the jury service system and to keep the jurors informed during their time of    service

To treat reporting jurors professionally

To have a good working relationship with judges, with trial attorneys, court reporters,    bailiffs, the public who serve as jurors, and the media

To ensure that jurors are available for jury selection

To make jury service as pleasant and enjoyable as possible for all who are summoned

Forms you will receive regarding your jury duty: Summons A legal notice delivered to citizens stating that they are required to report to the courthouse for jury duty. Juror Excusal/Disqualification Form (which is attached to the summons) A form that is to be dated and signed with the juror number and phone number requesting to be excused from jury duty if criteria is met by the reasons listed on the form. Juror Questionnaire Perspective jurors can print this form and fill it out, then bring the completed sheet with them on the day of their service to submit to Jury Assembly Staff. This form provides basic background information relating to spouses, employment, law enforcement officers in the family, prior litigation experience, and potential disabilities that might preclude service on a jury. Payment Affidavit A sworn affidavit of juror's employment and whether or not they are receiving wages while on jury duty. Exit Questionnaire A form given to citizens in which they evaluate their experience after they have completed their term of service. Certificate Of Jury Service A certification of day(s) of the juror's service (this form is at juror's request and is usually for the employer's benefit). It must be signed and sealed by the Clerk of Court Deputy Jury Clerk in order to be valid. Medical Request for Excusal A form to be filled out by physician or nurse practitioner that prevents the juror from serving due to medical reasons.
